Lawsuit Over

I would like to point out the entry over at Science-Based Medicine today. Tobinick Lawsuit Update – Justice Has Prevailed.

The summary:

"On September 30, the U.S. District Court for the Southern District of Florida granted Dr. Novella's motion for summary judgment, ending the lawsuit against him by Dr. Edward Tobinick and two of his companies."

Although I would suggest reading the the entry in its entirety at Science-Based Medicine.

The Society for Science-Based Medicine participation in the suit had been dismissed earlier in the year.

While the Society for Science-Based Medicine and the Science-Based Medicine blog are completely separate and independent organizations we share the same goals and some of the same writers and editors and are pleased with the dismissal.

Law and medicine are non-overlapping magisteria and the law is baffling and stressful to an outsider.  I spend all day in the acute care hospital taking care of acutely ill people. Issues of infection, life, and death cause nowhere near the level of angst that being involved in a lawsuit does.

I would like to take this opportunity to thank Jann Bellamy, JD,  for her calm and reassuring advice and demeanor through the whole ordeal.  You will never know how beneficial it was to have a professional on the team.
